Terms of Service — Manifest: USMCA Customs Docs

These Terms of Service ("Terms") govern your use of Manifest: USMCA Customs Docs ("the app", "we", "us"). By installing or using the app you agree to these Terms. If you do not agree, do not install or use the app.

1. The service

The app generates customs and shipping documents — including commercial invoices, USMCA Certificates of Origin, pick lists, packing lists, and lithium-battery handling marks — from your Shopify order data and the information you enter (such as HS codes, countries of origin, USMCA origin criteria, company details, and handling flags). The app is a document-generation tool.

2. Your responsibilities

You are the exporter and merchant of record. You are solely responsible for the accuracy and completeness of all information you provide and for determining whether your goods qualify for any tariff treatment you claim. You must review every generated document for accuracy before providing it to carriers, customers, or customs authorities. HS classification and origin determinations are your responsibility.

Special-handling flags and the lithium-battery mark are handling aids generated from your data; they do not classify, package, mark, or certify any shipment as compliant. Correct dangerous-goods classification, packaging, marking, documentation, and shipper training (for example under US 49 CFR or Canada TDG) remain your responsibility.

3. No professional advice

The app does not provide legal, customs, tax, or trade-compliance advice, and is not a substitute for a licensed customs broker, attorney, or other qualified professional. Documents are produced from your inputs and standard templates. You are responsible for ensuring your shipments comply with all applicable laws and regulations.

4. Acceptable use

You agree not to misuse the app, attempt to disrupt or gain unauthorized access to it, reverse engineer it, or resell or redistribute it. You are responsible for activity under your Shopify account.

5. Fees and billing

Paid plans are billed through Shopify according to the pricing shown on the app's Shopify App Store listing, including any free trial. You can cancel at any time by uninstalling the app. Charges are processed and managed by Shopify under its billing terms.

6. Availability and warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that generated documents will be accepted by any carrier or authority.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any customs penalties, fines, duties, shipment delays, or losses arising from your use of the app or from documents it generates. Our total liability for any claim relating to the app will not exceed the fees you paid for the app in the three months before the claim arose.

8. Data

Our handling of your data is described in our Privacy Policy, available at the /privacy page on this site.

9. Termination

You may stop using the app at any time by uninstalling it. Uninstalling ends your subscription and triggers deletion of your stored data as described in the Privacy Policy. We may suspend or terminate access if you breach these Terms or misuse the app.

10. Governing law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the app will be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the app after a change constitutes acceptance of the updated Terms.
